UK's top court backs extradition of WikiLeaks boss

LONDON (AP) ? Britain's Supreme Court has endorsed the extradition of WikiLeaks chief Julian Assange to Sweden, bringing the secret-spilling Internet activist a big step closer to prosecution in a Scandinavian court.

But a question mark hung over the decision after Assange's lawyer made the highly unusual suggestion that she would try to reopen the case, raising the prospect of more legal wrangling.

Assange, 40, has spent the better part of two years fighting attempts to send him to Sweden, where he is wanted over sex crime allegations. He has yet to be charged.

The U.K. side of that struggle came to an uncertain end Wednesday, with the nation's highest court ruling 5-2 that the warrant seeking his arrest was properly issued ? and Assange's lawyer saying she might contest the ruling.

Supreme Court President Nicholas Phillips, reading out the verdict, acknowledged that coming to a conclusion in the high-profile case had "not been simple."

Assange's story has been shot through with international intrigue, online activism, and scandal. But the case before the Supreme Court hinged on a narrow technicality: Did Swedish officials properly order his arrest?

His lawyers say "no." A prosecutor, not a judge, issued the warrant, a practice they've described as arbitrary and unfair. Swedish officials say "yes," arguing that, in Sweden as in other European countries, prosecutors carry out a quasi-judicial function.

The Supreme Court came down on Sweden's side Wednesday, with Phillips ruling that "the request for Mr. Assange's extradition has been lawfully made and his appeal against extradition is accordingly dismissed."

But scarcely had Phillips finished speaking before Assange lawyer Dinah Rose was on her feet, complaining that the court's ruling largely relied on a treaty whose interpretation she says she never had the chance to challenge.

In a surprise move, she requested extra time to study the judgment with an eye toward trying to reopen the case.

Phillips gave Rose two weeks to make a submission, meaning an extradition wouldn't happen until the second half of June at the earliest.

Such a maneuver is practically unheard of, according to attorney Karen Todner, whose law firm handles many high-profile extradition cases.

"It's very unusual," she told The Associated Press. "I've never known them to reopen a case."

Any eventual extradition of Assange could, however, be much later. Even if the Supreme Court refuses to revisit its judgment, Assange could appeal to the European Court of Human Rights, although Todner said he was unlikely to make much headway there unless he could argue that his physical safety or psychological well-being would be at risk in Sweden.

Assange, a former computer hacker from Australia, shot to international prominence in 2010 with the release of hundreds of thousands of secret U.S. documents, including a hard-to-watch video that showed U.S. forces gunning down a crowd of Iraqi civilians and journalists that they'd mistaken for insurgents.

His release of a quarter-million classified U.S. State Department cables in the final months of that year outraged Washington and destabilized American diplomacy worldwide.

But his work exposing government secrets increasingly came under a cloud after two Swedish women accused him of molestation and rape following a visit to the country in mid-2010. Assange denies wrongdoing, saying the sex was consensual, but has refused to go to Sweden, claiming he won't get a fair trial there.

He and his supporters have also hinted that the sex allegations are a cover for a planned move to extradite him to the United States, where he claims he's been secretly indicted for the WikiLeaks disclosures.

Those allegations, paired with the ponderous progress of Assange's appeals, have caused irritation in Sweden.

Claes Borgstrom, the lawyer who represents the two Swedish women who accuse Assange of sex crimes, expressed support for the verdict, but said he found it "difficult to understand" why the defense had been given the opportunity to try to reopen the case.

He dismissed suggestions that the underlying motive behind the extradition was to hand Assange over to the U.S.

"He is not at a greater risk of being handed over from Sweden than from Britain," he told the AP.

Borgstrom wasn't the only one expressing impatience. Ola Lofgren, of the Swedish prosecutor general's office, said it was in everyone's interest that the judicial back-and-forth "is shortened as much as possible."

Australia's government also weighed in, saying in a statement that it would "closely monitor" any proceedings against Assange in Sweden.

Unusually, Assange did not appear in court Wednesday; he was reportedly stuck in traffic. The WikiLeaks chief has spent much of the past 18 months living in a supporter's mansion in rural England.

Although his website has languished amid legal and financial issues, he's moved on to other projects, including a WikiLeaks-themed social networking site and a talk show on the Russian government's English-language broadcaster, RT.

WikiLeaks spokesman Kristinn Hrafnsson said Wednesday's judgment was "disappointing, but not surprising." He noted that Assange's legal options weren't exhausted, although he declined to speak about future strategy.

Marubeni buys Gavilon for $3.6 billion as it eyes China

TOKYO (Reuters) - Japanese trading house Marubeni Corp is to buy U.S. grains merchant Gavilon for $3.6 billion, the company said on Tuesday, as it targets China's growing demand for corn from North America, the world's top grain export hub.

China's corn purchases are expected to surpass Japan's annual imports of about 16 million metric tons (17. 6 million tons), the world's largest, within as little as three years, analysts say. China is already the world's top importer of soybeans.

"It's a move to complete a grains-supply chain of elevators, export terminals, freight handling and an end-user market, and the target is the growing market of China," said Akio Shibata, president of the Natural Resource Research Institute in Tokyo.

The U.S. grain trader has about $2 billion in debt, Marubeni said, which would take the total value of the transaction to $5.6 billion. The acquisition would be partly financed by bank borrowing, the Japanese firm added.

The announcement confirmed an earlier Reuters report.

It is the largest overseas acquisition, including debt, in agriculture or energy by a Japanese company since Japan Tobacco bought British cigarette manufacturer Gallaher Group for almost $19 billion in 2006, according to Thomson Reuters data.

Marubeni, Japan's fifth-largest trading company, had been in advanced talks to buy Gavilon since early May. Gavilon is the largest transaction in Marubeni's history, the company said.

Marubeni expects its global grain handling to rise to 55 million metric tons in the year to March 2013, when it adds Gavilon's 30 million metric tons to its business, coming closer in size to global grain giants like Cargill, Daisuke Okada, an adviser on food products to Marubeni President Teruo Asada, said at a briefing in Tokyo.

"We expect U.S. grains will fill future supply gaps in corn and other grains in China as output growth there may slow due to problems including water shortages," Okada said.

The company also said it expected the acquisition to lift its bottom line by more than $100 million from next year.

Acquiring Gavilon, whose owners include billionaire investor George Soros and hedge fund manager Dwight Anderson, may help the trading house challenge Archer Daniels Midland as the biggest supplier of grains and oilseeds from the United States to China.

"This acquisition supports an ongoing strategic plan by Asian grain importers to better secure future grain needs via the merger and acquisition process," said grains analyst Mike Zuzolo of Global Commodity Analytics.

"Realizing that better supply-chain management should better prepare these importers in their global sourcing needs."

Japan's trading houses, or "sogo shosha", have been scooping up assets around the world, targeting everything from shale gas to copper, as the world's third-largest economy competes with China, the second-biggest, for resources.

GOOD FIT

Gavilon is the third-biggest U.S. grain merchant in terms of the size of its marketing network, behind Archer Daniels and Cargill and also has large energy and fertiliser trading assets.

Gavilon now has about 320 million bushels of storage in the U.S. putting it ahead of global grain giants like Bunge Ltd and Louis Dreyfus.

"As part of a larger trading organization, Gavilon will be well-positioned to more efficiently connect supply with growing global demand," Gavilon President and Chief Executive Officer Greg Heckman said in a statement.

Marubeni's acquisition of Gavilon is unlikely to face any pushback from farmers and agricultural businesses, which have long been accustomed to the presence of Japanese grain companies in the United States.

"We anticipate minimal changes to our organization and operations," Heckman said.

A combination of Marubeni and Gavilon is seen by analysts as a good commercial fit, marrying Gavilon's presence in the U.S. Central Plains and Midwest with Marubeni's operations in the Pacific Northwest - the shortest U.S. sea route to Asia.

Gavilon also has a large footprint in the U.S. fertilizer market, an energy operation that includes 7 million barrels of crude oil storage and an oil, grain and ethanol trading unit.

Morgan Stanley is advising the U.S. company on the transaction, Gavilon said. Nomura is advising Marubeni, people involved in the discussions have said.

Marubeni's rivals Mitsui & Co and Mitsubishi Corp had both been seen as potential bidders for Gavilon but decided not to pursue a deal.

Japan's outward bound mergers and acquisitions totaled $25.4 billion, including debt, this year to date, versus $15.1 billion for Chinese overseas purchases, according to Thomson Reuters data.

There were 245 overseas purchases or investments by Japanese companies compared with 101 for those from China.

Large trading houses in Japan have more than doubled overseas acquisitions, investing $7.7 billion so far this year, up from $3.5 billion in the same period in 2011.

Marubeni said in 2009 it signed a letter of intent with Sinograin, a Chinese state firm, to "work closely in coming years" to build state reserves and commercial grain supplies.

In the next marketing year that starts in October, the market is expecting a 60 percent jump in China's corn imports to around 8 million metric tons.

In part, the shosha may be betting that Japanese companies can make in-roads where China's state-owned traders fear to tread.

Late last year, Chinese state-owned trading house COFCO said it was seeking acquisitions to secure supplies in the United States, Australia, Russia and South America. But it has not advanced any major purchases, although it has sent teams to various countries for discussions, sources said.

Beijing-backed firms have shied away from attempts at large U.S. takeovers since a political furor scuppered offshore oil driller CNOOC's bid for Unocal seven years ago, analysts say.

Marubeni is already the second-largest exporter of U.S. grains to China, with soybean shipments surging five-fold since 2008, based on data from trade intelligence firm PIERS. Marubeni handled nearly 20 percent of China's soybean imports in 2010, according to its annual report.

Unlike Marubeni, Gavilon has not made deep inroads into China, having exported less than 10,000 metric tons of grains over the past two years, data showed.

Marubeni is the best-established shosha inside the U.S. grain belt. In 2010, it overtook Japan's national federation of farm cooperatives Zen-noh as the biggest Japanese exporter of U.S. grains and oilseeds, according to PIERS data, and accounts for more than a third of all shipments by Japan-based firms.

McCain: Don't count on Russia to force out Assad

WASHINGTON (AP) ? The U.S. can't count on Russia ? a major arms supplier to Syria ? to force President Bashar Assad from power, Sen. John McCain said Sunday, blaming President Barack Obama for embracing a "feckless" foreign policy and punting tough decisions until after the fall election.

"What the conclusion you can draw is that this president wants to kick the can down the road on all of these issues until after the election. ... It's really an abdication of everything that America stands for and believes in," he later added.

Mitt Romney, Obama's presumed rival in this year's presidential election, said Obama "can no longer ignore calls from congressional leaders in both parties to take more assertive steps." He said the current approach has only given Assad more time to crackdown on protesters.

"The United States should work with partners to organize and arm Syrian opposition groups so they can defend themselves," Romney said.

The White House called for Assad's ouster as recently as Saturday when it blamed the Syrian government for the deaths of more than 100 people, including 49 children, following peaceful protests. National Security Council spokeswoman Erin Pelton said the attack serves as a "vile testament to an illegitimate regime." The Syrian government has denied responsibility.

The U.N. Security Council held an emergency meeting Sunday afternoon to discuss the massacre, which took place in the Syrian town of Houla.

A council statement released after the meetings "condemned in the strongest possible terms the killings, confirmed by United Nations observers, of dozens of men, women and children and the wounding of hundreds more in the village of Houla, near Homs, in attacks that involved a series of government artillery and tank shellings on a residential neighborhood."

It also "condemned the killing of civilians by shooting at close range and by severe physical abuse," but avoided assessing responsibility for the killings.

Before the meeting, Russia's Deputy U.N. Ambassador Alexander Pankin had questioned whether Syrian tanks and artillery were responsible for the killings. He told reporters "there is substantial ground to believe that the majority of those who were killed were either slashed, cut by knives or executed at point-blank distance."

Earlier this month, at the meeting of leading industrial nations at Camp David, White House officials said they had hoped Russia could use some of its sway to halt the bloody crackdown and raised the possibility of modeling a regime change in Syria after Yemen. Yemen's longtime President Ali Abdullah Saleh stepped down in February as part of a U.S.-backed power transfer deal that gave him immunity from prosecution in return for relinquishing power.

According to U.S. Deputy National Security Adviser Ben Rhodes, Russian Prime Minister Dmitry Medvedev "did not dispute the fact that there needs to be a process of political transition" in Syria.

"I think the question is, just how does that manifest itself?" Rhodes told reporters at a May 19 press conference.

The United States wants to avoid escalating a confrontation with Moscow over Syria, but wants Medvedev to hear the depth of international outrage. Specifically, the U.S. wants to prevent another Security Council showdown, in which Russia might feel it had to veto any anti-Assad proposals on principle and the U.S. would lose that avenue as a practical alternative. Moscow and Beijing have already twice shielded Syria from U.N. sanctions over the crackdown.

According to one official, who spoke on condition of anonymity to discuss internal diplomacy, the U.S. focus is now on getting Russia to tolerate a "political transition" in Syria similar to Yemen.

But McCain says the U.S. would be foolish to rely on Russia, a main supplier of arms to the Syrian military.

"Here we are a year later and 10,000 killed," he said, referring to the onset of protests across the Arab world. And "our hopes rest on convincing (Russia) to ease out Assad, comparing it to Yemen, which there is no comparison. It's really just a sad story."

There's also no shortage of retailers who have signed on to offer not just mobile payments, but coupons and loyalty credits as well -- Walgreens, Toys R Us, Macy's, The Gap, and Foot Locker, to name a few, with more promised.

Unfortunately, while MasterCard allows the service to be accepted at plenty of retailers, you still need a Citibank MasterCard to get the most out of it. Other cardholders can use the service, but you'll need to regularly top up your Google Wallet account rather than draw funds directly from your credit card. There's no word on any further expansion in that area just yet.

The Competition

Google faces a number of challenges on the road to widespread adoption of the service, not the least of which is some increased competition. Its biggest rival by far (at least in the US) is Isis, a joint venture between AT&T, T-Mobile and Verizon that's challenging Google and Sprint head-on -- offering the same contactless payments, coupons and loyalty cards, with an NFC-enabled smartphone handling all of the transactions. Also like Google Wallet, it's starting out slow, with trials in just two cities this summer (Salt Lake City and Austin), and a limited, but growing, number of credit card partners (currently including Chase, Capital One and American Express). Perhaps its biggest advantage over Google Wallet, though, is the promise of far more supported phones (from virtually all of the big manufacturers, Apple aside) on all three of the aforementioned carriers.

The company would also face several challengers if it intends to compete on an international level. A group of the UK's biggest carriers are forming their own Isis-like joint venture, Rogers and CIBC recently announced an initiative of their own in Canada, and various other partnerships and solo efforts are starting to sprout up around the globe before Google even gets its foot in the door.

The Future

So what will year two of Google Wallet look like? That's still very much a guessing game at this point, with Google itself staying relatively mum on any future plans beyond those aforementioned (but still unspecified) new devices and additional retail partners. The Wall Street Journal did recently report that Google may be considering a shift in strategy, however, with it possibly either sharing revenue with carriers in order to bring more on board or even side-stepping the carriers altogether and instead working directly with retailers to manage transactions. What is clear, though, is that this next year will likely be the most interesting time yet for mobile payments -- an area that, for all its progress, is still really just beginning to get off the ground.
